Yes, you've convinced me that any legal or moral framework that relies on detecting INTENTIONS is functionally indistinguishable from witchcraft.

By your "consequentialist" view, nobody should ever be convicted of accidentally or unintentionally committing a crime.

Isn't that one of the KEY legal obstacles to convicting TRUMP of many of his CRIMES?

It's been argued that the Georgia phone call was NOT criminal if TRUMP sincerely believes that he really and truly WON.

This would magically transform the phone call from being an implicit demand for falsifying vote tallies into an honest and sincere plea for "THE TRUTH".

ALSO,

There was a case a few years ago where a police officer accidentally entered a neighbor's apartment, mistakenly thinking it was their own apartment and mistook their neighbor for an INTRUDER and shot them dead.

Their legal defense argued that it was not a crime because the officer sincerely believed their neighbor was an intruder.

Police are protected by a legal doctrine called "qualified immunity" which states that (IFF) the office believed at the time that what they were doing was perfectly legal, (THEN) their case can be dismissed. [LINK]

Why do you think Trump supporters should be jailed?  Your talking about jailing roughly half the country.  Seems extreme.
As my mother always stated, where there's a will, there's a way.  Of course the will cannot violate inviolate cosmic laws/principles.

The only way you could jail Trump supporters is to increase the police budget drastically (so much for giving police less money), you would need substantial increases to the prison budget, it is a complete violation of the 1st and 8th amendment.  Trump supporters are not being jailed, and they shouldn’t be.

People calling for Trump to be impeached or put in jail are idiots. Who exactly is going to jail Trump when half  the country thinks he was a good president?

It is amazing that TDS has caused Democrats not to remember the weeks of cities burning and police stations occupied and people and police officers being killed. But a handful of people being let into the Capitol one day - is treason on Trump. What hypocracy.

Trump caused an angry mob to attack the capitol. The pre-march rhetoric suggests that it was probably purposeful. (e.g. "trial by combat" "show strength" "be strong") Not sure if that's treason or not, but it's pretty close.

My doubts about what he did constituting treason have to do with whether or not causing an angry mob to attack a federal building constitutes an act of war. It doesn't seem to be a very warlike thing to me. If they had lots of bombs and guns and had used them, then maybe it would be.

If you read my prior posts here I made it pretty clear that I don't think arresting and prosecuting Trump is in our national interests because healing and unity is required. Dispassionate factualism is important to that too. People get lost in echo chambers and are dealing with completely different sets of facts. The truth is the common ground, and if we deny ourselves that then we're never going to be agreeing on much. Look at what you're doing. You're focusing on two statements, ignoring the third, and not considering the whole context. Trump knew they were angry. Trump knew they believed the election was stolen. Trump sent them to the capitol. What happened was easily foreseeable and Trump didn't seem to take any steps to prevent it. In fact, according to a report from a GoP senator, Trump was "delighted" by what was happening.
