There is solid evidence to prove you are scum. Granted it might be false, but there is evidence based off the actions claimed by town and my reads and how the mechanic works. Obviously they could be lying but if this is a trial and you are a judge, you have to make the best judgement based on the evidence given

Hopefully you see my point. The only variable isn't the number of players. Circumstantial evidence plays the role in separating one player from the crowd.
