Legal definition of rape:

"Penetration, no matter how slight, of the vagina or anus with any body part or object, or oral penetration by a sex organ of another person, without the consent of the victim."

So when a grown woman has sex with a 12 year old boy, she is not penetrating him. Thus, she is not raping him. He is the one doing the penetration.

But when a grown man has sex with a 12 year old girl, he is a rapist by definition.

So a grown woman who has sex with a 12 year old boy is by definition NOT a rapist.

Besides, saying that children cant consent is a self-negating argument, since it is based on a premise that lack of consent makes action wrong. So if children cant consent, then they cant consent to anything and every action is wrong, from school to healthcare.

However, rape is federally defined (even though individual state definitions may differ) for statistical purposes as:[1]

By this federal definition, as given in first post, woman having sex with an underage boy isnt rape. So by this federal definition which beats all other definitions, you cannot call her a rapist.

I think that would even be "cruel and unusual punishment", so legal rights of pedophiles are maybe being violated there.
