Holy hell, I don't think there is a cognitive braincell by any democrat. I don't think democrats allow the ability to critical think. A law that removes cash bail for almost every crime? This is a purge law

The democratic party, destroying the states we live in just for their stupid PC social justice. Don't know how these morons still have a job

It’s all fun and games until you experience it. Rich white liberals don’t care because they have their private security

In a fair and diligent legal system, bail would an unnecessary privilege.

Though legal systems are usually corrupted by financial considerations anyway.

I don't imagine that a Republican led legal system would be any less corrupt than a Democrat led system.

How do you still have a job as deputy moderator?

There is your answer.

This isn't about corruption. This is a question on what to do with a violent person after you detain them at the scene of a crime.

Whether you are in a "functioning democracy" or a dictatorship is irrelevant because criminals exist under all systems.

It does seem like there is an endless cycle post WWII of:

Leftists feel bad for criminals, pass laws that make things easier on criminals. Criminals respond by committing more crimes. Leftist lose elections because people are being victimized by the criminals they're easy on. Leftists rebrand as "tough on crime" and win, change laws. Leftists feel bad for criminals...

There is nothing new under the sun. But the party that's doing this facing future electoral problems is pretty scant consolation for the victims. It's truly shocking just how much sympathy a lot of leftists have for criminals, and how little they have for ordinary people

Liberals legitimately have more sympathy for a hardened violent criminal than they do for an ordinary person who utters a racial slur once during a heated confrontation. Sick ideology!

That is why we have felony and misdemeanour classifications.

I was referring to the corrupt nature of a legal system, where the primary consideration is money.

Shouldn't the application of law not be based upon the ability of the individual to pay.

But solely upon the precise interpretation of law.

The alternative is to hold everyone equally locked up until their trial.

The original intent of the bail system was designed to address prison overcrowding by allowing families to put their property up as collateral to ensure a person will make a trial date. But if that seems unfair, then everyone can stay in jail and you can pay for it.

I’m not entirely sure what the problem is, are you suggesting that you were fine with dangerous criminals being let out onto the streets provided that they managed to cobble together enough cash? Is this a conservative bootstrap thing - that you only want criminals with moxie and means to be let out.

I thought you guys were all anti-tyranny and government oppression? Isn’t “you’re innocent until proven guilty - but also you’re poor, so off to jail with you” an obvious case of the government clearly being dicks?

The law does offer other forms of punishment besides money fines such as community work, house arrest etc.

I was referring not to the accused, but to a legal system corrupted by money.

How can one apply law evenly if one has a vested interest in not doing so?

So your telling me kidnappers, robbers, people who commit second degree murder, and arsonists, should be allowed to roam free without bail?

No, if they’re a risk to society, or flight - they shouldn’t be offered bail at all. People who pose a credible flight risk or risk to society should be - and are - held on pre-trial detention; which still exists, and hasn’t changed despite what your social media memes told you.

With and without cash bail - to be granted bail, a judge is ruling you don’t pose a danger to the public. If cash bail was the thing that was preventing murders being let out, it means judges are ruling things like:  “you’re a mass murderer, and could easily kill - so I’m only going to let you out if you and your friends can cobble together $20k”, which is pretty absurd.

Correct. It's why we have law in the first place.
