“On May 9, 1865 Union soldiers found Davis's encampment near Irwinville, Georgia. He tried to evade them, but was captured wearing a loose-sleeved cloak and covering his head with a black shawl,[241] which gave rise to depictions of him in political cartoons fleeing in women's clothes.[242]

Davis was captured, accused of treason, and imprisoned at Fort Monroe. He was released without trial after two years”

Soon after losing the Civil War in 1865, states that had been part of the Confederacy began to send "unrepentant" former Confederates (such as the Confederacy's former vice president, Alexander H. Stephens) to Washington as senators and representatives. Congress refused to seat them and drafted Section 3 to perpetuate, as a constitutional imperative, that any who violate their oath to the Constitution are to be barred from public office.

Section 3 disqualifies from federal or state office anyone who, having taken an oath as a public official to support the Constitution, subsequently has "engaged in insurrection or rebellion" against the United States or given "aid and comfort" to its enemies.

Nothing in there about being convicted of treason or insurrection

Not the states. Congress.

That was referring to the passage of laws.

The Constitution explicitly says the states run their elections, which includes enforcement of disqualification.

Think about it. These people were banned from Federal AND state office. Are you suggesting Congress would prevent people from running for state offices, such as governor? That’s ridiculous

Sure, but federal law > state law per the supremacy clause, especially in the case of federal elections.

Punish southern states for participating in insurrection. There’s nothing radical about that. It’s called justice.

No, it was not up to Congress to enforce the prohibition of former rebels holding state or federal office. It was up to state elections officials to keep them off the ballot.

That is what Colorado is doing with Trump. That is what every other state should be doing.

That simply isn’t true. States can run their federal elections anyway they like as long as they don’t violate federal law.  In this case. Federal law says insurrectionists can’t run for office. Trump is an insurrectionist. And there is nothing that says they must be convicted of insurrection. It’s ok to simply believe your own eyes and ears and see plainly that Trump is an insurrectionist. That is what the Colorado court did.


Trump swore an oath to the Constitution, he broke that oath, now he is banned from serving again. Pretty simple to understand.

Trump solicited election fraud. That is why he has been indicted and is facing trial next year.

After Lincoln was shot and killed, on April 15th, his successor, Andrew Johnson, issued a proclamation charging that Lincoln’s assassination had been “incited, concerted, and procured by” Davis and offering a reward of a hundred thousand dollars for his arrest.

When the United States failed to prosecute Jefferson Davis for treason or insurrection, they planted the seeds of 150 years of racism in this country.

What will a failure to prosecute Donald Trump for these crimes do to America? Will it be the beginning of the end of the United States?
